Terms And Conditions

Availability

  • To minimise the risk of items becoming unavailable while the list is 'live', we suggest you set it up no more than eight to ten weeks before the event.
  • If you select discontinued lines while setting up your list in store, we won't be able to add them, and we'll let you know when we send you the confirmed list. (it's not possible to select discontinued items online).
  • Due to the seasonal nature of some products, guests occasionally buy items which become unavailable while the list is still open. If this happens, we'll replace the cost of the items with gift vouchers.
  • Whilst every effort is made to ensure availability, we cannot guarantee the availability of items on the list.

Changing your list

  • We cannot accept any changes to your list from a third party.
  • Changes cannot be made to a list once it is closed.

Gift Vouchers

  • Your guests have the option to buy gift vouchers with any gift list.

Promotional Gift Vouchers

  • You will receive £100 in vouchers, providing £2000 or more has been purchased.
  • The offer is valid for a limited time only, from 1st April 2007 until 31st December 2007.
  • We'll send you the vouchers by recorded delivery once your list has closed, or you can collect them in store.
  • You can spend your vouchers in any Heal's store on any product, but you can't exchange for cash.

Pricing

  • Occasionally, we may have to change the price of items on your list.
  • Guests pay the current selling price of the gift they wish to buy, therefore the price paid may vary during sale and non-sale periods.

Closing your list and arranging delivery

  • You can close your list and arrange delivery online - or ask us to do it for you by calling the Wedding & Gift List department.

When you close the list

  • You can spend any e-vouchers online on any remaining items on your list, or convert them to paper vouchers to spend later.
  • If you have any furniture items that are part paid for, you can either pay the balance yourself or convert the payments into Heal's vouchers.
  • You can also choose whether you want to buy any items left on your list yourself.
  • If you do not close your list, it will close automatically six weeks after the event, and we will contact you to arrange delivery.

Arranging delivery

  • We usually arrange to deliver your gifts (excluding special order products) about two weeks after the list closes.
  • We deliver free within a certain area, arranging a date with you beforehand.
  • We deliver Monday to Friday. Morning deliveries are between 8am and 1pm and afternoon deliveries between 12pm and 5pm.
  • If you live outside our free delivery area, there is a charge. We also charge you if you need more than one delivery (we can provide a quote when you register or when you book delivery).
  • Free delivery only applies to lists over £500 in value.
  • If you prefer, you can arrange to collect your gifts from any of our stores or our distribution centres in North London or Manchester.
  • We'll post any gift vouchers to you separately by Special Delivery.

Exchanging items

  • You can exchange items in any Heal's store within 28 days of delivery. You'll need to show your closure delivery/collection email when you change the item.
  • If you select items online you can return unwanted gifts to any of our stores with proof of list.
  • Gifts cannot be exchanged prior to delivery once they have been purchased by guests.

Damages

  • Make sure you tell us about any breakages or missing items by calling the Wedding & Gift List department within a week of delivery. Unfortunately, after this time we can't accept responsibility.

Special order products

  • Special order products cannot be exchanged or refunded once confirmed before list closure.
  • These items are ordered directly from the supplier once your list has been closed and can have a lead time of up to 6 weeks. We'll post the items out to you separately by special delivery or alternatively you can collect from any of our stores or distribution centres.

General:

Indemnity

  • You agree fully to indemnity, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of the use of this website.

Orders

Order acceptance and the completion of the contract between you and Heal’s will take place on the despatch of the products purchased to the List Holder(s), unless we have notified you that we do not accept your order. Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock
  • Our inability to obtain authorisation for your payment
  • The identification of a pricing or product description error
  • You not meeting the eligibility to order criteria set out in the Terms & Conditions

If there are any problems with your order, you will be contacted by our Customer Services Representatives. We reserve the right to withdraw any product from a Gift List or to reject any offer to purchase by you at any time. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

We reserve the right to change the conditions from time to time, and your continued use of the website, (or any part thereof), following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the conditions have been changed. If you do not agree to any change to the conditions then you must immediately stop using the website.

Contract Cancellation

The contract of any purchase is deemed to have been concluded upon delivery of the goods to the List Holder. Therefore, please note that you are entitled to cancel if you so wish providing that the gifts have not been delivered to the holder of the Gift List.

Description of Products

Each product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information, including Product Descriptions, appearing on this Website at a particular time may not always reflect the position at the exact moment you place an order.

Alcoholic Merchandise

We may sell products containing intoxicating liquor. For clarity, a drink containing alcohol is classified as intoxicating, if it contains more than 0.5% of alcohol by volume (0.5% abv). Pursuant to the Licensing Act 1964 it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18, subject to a maximum fine on conviction of £1000. In accepting these Conditions you agree to provide Heal’s Online truthful and accurate information and act in accordance with the Licensing Act of 1964.

Payment

All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

Refusal of Transaction

We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:

  • Register by providing your real name, phone number, e-mail address, payment details and other requested information
  • Be over 18 years of age
  • Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
  • Possess a valid credit or debit card issued by a bank acceptable to us

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
